I hereby grant Leah Zawadzki [photographer], the absolute and irrevocable right and unrestricted permission concerning any photographs that she has taken or may take of those listed in this contract [minor and adult], to use and publish the photographs in whole or in part, individually or in connection with other material, in any and all media now or hereafter known, including the internet, illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration. I release and discharge Leah Zawadzki from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also insure to the benefit of the heirs, legal representatives, licensees, and assigns of Leah Zawadzki, as well as the person(s) for whom she took the photographs.

I do not grant permission to Leah Zawadzki rights to publish photographs online.

TERMS AND CONDITIONS *

RETAINER POLICY The non-refundable session fee covers time and talent, including the planning, communication, and preparation of the session, the session itself, and the time spent photographing and editing the images. This session fee is due to reserve your session date and time. The session fee does not cover the rights to digital downloads and does not apply to prints or products. High-resolution image files and products are available for download via collections. 

GALLERY SLIDESHOW AND PORTRAIT ORDERS About two weeks after the session, the client will receive a slideshow of curated, hand-edited images and preview their online gallery. The slideshow will be available 24 hours after the client has clicked the link and viewed the slideshow. The client will purchase a collection within 24 hours of accessing your gallery slideshow. All orders are placed via the online gallery and are available for viewing and ordering for 30 days. Please pay attention to the expiration date of your gallery. 

COPYRIGHT INFORMATION Leah Zawadzki, the photographer, owns the copyright to the images produced at your session. It is illegal to scan, copy, or reproduce work in any way without a license for personal use. Personal use licenses are provided when purchasing high-resolution digital files via a print release. This release does not cover commercial use; please contact me for additional pricing if you wish to use your images for anything other than personal. 

TRAVEL FEE Twenty-mile round-trip travel is included with every session [from Orange County 92869 zip code]. For additional travel, there is a $3.50 per mile fee. Inquire about long-distance travel rates.

ILLNESS If anyone in your party feels ill, please reschedule at least 24 hours before your session. Photos do not turn out well if the subject is sick! If the photographer is sick, she will reschedule to a time convenient to the client's schedule.

EXCLUSIVE PHOTOGRAPHER Only the individuals being photographed [and the parents] are allowed at the photo session. Camera, camcorder, or other recording device is not permitted.

RETOUCHING All gallery images are custom, creatively edited, and 'touched up.' Any additional retouching requests are billed at $100 per hour [$50 minimum].

REPRINTS All gallery images are archived and kept on file for one year. The client is responsible for downloading and backing up all purchased images. The photographer will not keep or store digital images long term.

PORTRAIT CARE Please be sure to handle your portraits with extreme care. Leah is not responsible for any damage incurred due to improper handling, framing, hanging, etc.

Client will not screen capture any images that have not yet been purchased to share on social media. 

Once files are purchased, images may be shared on social media with proper credit to the photographer in the caption. Please tag @leahzawadzki_portraits on all social media posts.

The photographer will be available for phone consultation or at-home meetings to help in the selection process, if needed, at no additional charge. 

Due to the custom nature of each session, all sales are final.

Client agrees to the Terms and Conditions as outlined.
